31. Technical condition of vehicles and their equipment
31.1.

The technical condition of vehicles and their equipment must comply with the requirements of standards relating to road traffic safety and environmental protection, as well as the rules of technical operation, the instructions of manufacturing enterprises and other regulatory and technical documentation.


31.2.

Operation of trolleybuses and trams is prohibited if there is any malfunction specified in the technical operation rules for these vehicles.


31.3.

Operation of vehicles is prohibited in accordance with the law:

a) if they are manufactured or re-equipped in violation of the requirements of standards, rules and regulations relating to road traffic safety;

b) if they have not passed mandatory technical control (for vehicles subject to such control);

c) if the number plates do not meet the requirements of the relevant standards;

d) in case of violation of the procedure for installation and use of special light and sound signaling devices.


31.4.

Operation of vehicles is prohibited in accordance with the law if the following technical malfunctions or non-compliance with the following requirements are present:


31.4.1.

Brake systems:

a) the design of the brake systems has been changed, or brake fluid, units or individual parts not provided for this vehicle model or not complying with the manufacturer requirements have been used;

b) during road tests of the service brake system, the following values are exceeded:

The standard braking distance value for vehicles manufactured before 1988 may be exceeded by no more than 10 percent of the value shown in the table.

  • Note No. 1. The service brake system test is carried out on a horizontal section of road with an even, dry, clean cement-concrete or asphalt-concrete surface at the vehicle speed at the beginning of braking: 40 km/h for cars, buses and road trains; 30 km/h for motorcycles and mopeds, using a single application of the brake controls. Test results are considered unsatisfactory if during braking the vehicle turns by an angle greater than 8 degrees or occupies a lane wider than 3.5 m.

  • Note No. 2. The braking distance is measured from the moment the brake pedal (lever) is pressed until the complete stop of the vehicle;

c) the hydraulic brake drive is leaking;

d) the pneumatic or pneumohydraulic brake drive is leaking, causing the air pressure with the engine off to decrease by more than 0.05 MPa (0.5 kgf/sq.cm) within 15 minutes when the brake controls are actuated;

e) the manometer of the pneumatic or pneumohydraulic brake drive does not work;

f) with the engine disconnected from the transmission, the parking brake system does not ensure an immobile condition of:

  • vehicles with full load - on a slope of at least 16%;

  • passenger cars, their modifications for cargo transportation, as well as buses in running order - on a slope of at least 23%;

  • cargo vehicles and road trains in running order - on a slope of at least 31%;

g) the lever (handle) of the parking brake system does not lock in the working position;


31.4.2.

Steering:

a) the total steering free play exceeds the following limit values:

b) there are mutually perceptible movements of steering parts and assemblies not provided for by the design, or their movement relative to the body (chassis, cab, frame) of the vehicle; threaded connections are not tightened or reliably secured;

c) the power steering or steering damper (on motorcycles) provided for by the design is damaged or absent;

d) steering contains parts with traces of residual deformation and other defects, and parts or working fluids not provided for this vehicle model or not complying with the manufacturer requirements have been used.


31.4.3.

External lighting devices:

a) the number, type, color, placement and operating mode of the external lighting devices do not comply with the vehicle design requirements;

b) the headlights are improperly adjusted;

c) the left headlamp bulb does not work in dipped beam mode;

d) lighting devices do not have lenses, or lenses and lamps are used that do not correspond to the type of the given lighting device;

e) the lenses of lighting devices have tinting or coating applied that reduces their transparency or light transmission.

Note No. 1. Motorcycles (mopeds) may additionally be equipped with one fog lamp, other mechanical vehicles with two. Fog lamps must be placed at a height of at least 250 mm from the road surface (but not higher than dipped beam headlamps), symmetrically to the longitudinal axis of the vehicle and not farther than 400 mm from the outer width dimension.

Note No. 2. It is permitted to install one or two rear fog lamps of red color on vehicles at a height of 400-1200 mm and no closer than 100 mm to the stop lamps.

Note No. 3. Fog lamps and rear fog lamps must be switched on simultaneously with the position lamps and number plate lighting (dipped or main beam headlamps).

Note No. 4. It is permitted to install on a passenger car and a bus one or two additional non-flashing red stop signals at a height of 1150-1400 mm from the road surface;


31.4.4.

Windshield wipers and windshield washers:

a) the windshield wipers do not work;

b) the windshield washers provided for by the vehicle design do not work;


31.4.5.

Wheels and tires:

a) tires of passenger cars and cargo vehicles with a permitted maximum mass up to 3.5 t have a remaining tread pattern height of less than 1.6 mm, cargo vehicles with a permitted maximum mass over 3.5 t - 1.0 mm, buses - 2.0 mm, motorcycles and mopeds - 0.8 mm.

  • For trailers, the same remaining tread pattern height standards are established as for the tires of towing vehicles;

b) tires have local damage (cuts, ruptures, etc.) exposing the cord, as well as carcass delamination, tread and sidewall separation;

c) tires do not correspond to the vehicle model by size or allowable load;

d) diagonal tires are installed together with radial tires on one axle of the vehicle, studded and non-studded tires, frost-resistant and non-frost-resistant tires, tires of different sizes or constructions, as well as tires of different models with different tread patterns for passenger cars and different tread pattern types for cargo vehicles;

e) radial tires are installed on the front axle of the vehicle, and diagonal tires on another axle (other axles);

f) on the front axle of a bus performing intercity transportation, tires with restored tread are installed, and on other axles - tires restored by the second repair class;

g) on the front axle of passenger cars and buses (except buses performing intercity transportation), tires restored by the second repair class are installed;

h) a fastening bolt (nut) is missing or there are cracks in the disk and wheel rims;

Note No. 1. In the case of continuous operation of the vehicle on roads where the carriageway is slippery, it is recommended to use tires corresponding to the condition of the carriageway.


31.4.6.

Engine:

a) the content of harmful substances in the exhaust gases or their smoke opacity exceeds the standards established by the standards;

b) the fuel system is not airtight;

c) the exhaust gas discharge system is faulty;


31.4.7.

Other structural elements:

a) the glass and rear-view mirrors provided for by the vehicle design are missing;

b) the sound signal does not work;

c) additional items are installed on the glass or a coating has been applied that restricts visibility from the driver's seat and worsens its transparency.

  • Note to subparagraph "c". Transparent colored films may be fixed to the upper part of the windshield of cars and buses. It is permitted to use tinted glass (except mirror glass) whose light transmission complies with the requirements of GOST 5727-88. Curtains may be used on the side windows of buses;

d) the locks of the body or cab doors, the side-board fasteners of the cargo platform, the tank neck and fuel tank fasteners, the driver's seat adjustment mechanism, emergency exits, devices for actuating them, the door control drive, speedometer, odometer, tachograph, and windshield heating and blowing device provided for by the design do not work;

e) the main leaf or center bolt of the spring is broken;

f) the towing or supporting coupling device of the towing vehicle and the trailer link as part of a road train is damaged, as well as the safety cables (chains) provided by their design. There is play in the connections of the motorcycle frame with the sidecar frame;

g) the bumper or rear protective device, mud flaps and splash guards provided for by the design are missing;

h) the following are absent:

  • a first-aid kit bearing information about the type of vehicle for which it is intended - on a motorcycle with a sidecar, a passenger car, cargo vehicle, wheeled tractor, bus, minibus, trolleybus, and a vehicle transporting dangerous cargo;

  • an emergency stop sign (flashing red lamp) meeting the requirements of the standard - on a motorcycle with sidecar, a passenger car, cargo vehicle, wheeled tractor, and bus;

  • on cargo vehicles with a permitted maximum mass over 3.5 t and buses with a permitted maximum mass over 5 t - wheel chocks (at least two);

  • orange flashing beacons on heavyweight and oversized vehicles, on agricultural machinery whose width exceeds 2.6 m;

  • a serviceable fire extinguisher on a passenger car, cargo vehicle, and bus.

Note to subparagraph "h" No. 1. The type, brand and places of installation of fire extinguishers with which vehicles bearing the identification sign “Orange plate” transporting dangerous goods are equipped are determined by special rules.

Note to subparagraph "h" No. 2. The first-aid kit, the list of medicines in which corresponds to DSTU 3961-2000 for the relevant type of vehicle, and the fire extinguisher must be secured in the places determined by the manufacturer. If such places are not provided for by the vehicle design, the first-aid kit and fire extinguisher must be located in easily accessible places. The type and number of fire extinguishers must comply with the established standards. Fire extinguishers with which vehicles are equipped must be certified in Ukraine in accordance with the requirements of the law;

i) seat belts and head restraints are missing in vehicles where their installation is provided for by the design;

j) seat belts are not in working condition or have visible tears in the webbing;

k) the motorcycle lacks the safety bars provided for by the design;

l) motorcycles and mopeds lack the footrests provided for by the design, and the seat lacks transverse handles for the passenger;

m) the headlamps and rear position lamps of a vehicle transporting oversized, heavyweight or dangerous cargo are absent or faulty, as well as flashing beacons, reflective elements and identification signs provided for by paragraph 30.3 of these Rules.


31.5.

If malfunctions specified in paragraph 31.4 of these Rules arise on the road, the driver must take measures to eliminate them, and if this is impossible - drive by the shortest possible route to a place of parking or repair while observing precautions and complying with the requirements of paragraphs 9.9 and 9.11 of these Rules.

If malfunctions specified in paragraph 31.4.7 ("m"; "f" - as part of a road train) arise on the road, further movement is prohibited until they are eliminated. The driver of the faulty vehicle must take measures to move it beyond the carriageway.


31.6.

Further movement of vehicles is prohibited if:

a) the service brake system or steering does not allow the driver to stop the vehicle or perform a maneuver while moving at minimum speed;

b) in the dark time of day or in conditions of insufficient visibility the headlamp or rear position lamp bulbs do not work;

c) during rain or snowfall the windshield wiper on the steering wheel side does not work;

d) the towing device of the road train is damaged.


31.7.

Operation of a vehicle by delivering it to a special site or parking area of the National Police is prohibited in cases provided for by the law.
