2. Obligations and rights of motor vehicle drivers
2.1.

The driver of a motor vehicle must have:

a) a driving licence for the right to drive a vehicle of the corresponding category;

b) the vehicle registration document (for vehicles of the Armed Forces, National Guard, State Border Guard Service, State Special Transport Service, State Special Communications Service, Operational and Rescue Service of Civil Protection — a technical pass);

c) in case of installation of flashing beacons and (or) special sound signalling devices on vehicles — a permit issued by the authorized body of the MIA, and in case of installation of an orange flashing beacon on oversized and overweight vehicles — a permit issued by the authorized unit of the National Police, except for cases of installation of orange flashing beacons on agricultural machinery with a width exceeding 2.6 m, on mechanical vehicles of the road maintenance service, on special and specialized purpose vehicles and on vehicles with the identification sign "Children";

d) on route transport vehicles — the route scheme and timetable; on overweight and oversized vehicles and vehicles carrying dangerous goods by road — documentation in accordance with the requirements established by the Laws of Ukraine "On Motor Transport", "On Road Traffic" and "On Transportation of Dangerous Goods" (hereinafter — special rules);

e) a valid insurance policy (insurance certificate "Green Card") on the conclusion of a compulsory civil liability insurance contract for owners of land vehicles or a valid domestic electronic contract of the said type of compulsory insurance in the visual form of an insurance policy (on electronic or paper media), information about which is confirmed by data contained in the unified centralized database operated by the Motor (Transport) Insurance Bureau of Ukraine. Drivers who, in accordance with the legislation, are exempt from compulsory civil liability insurance for owners of land vehicles on the territory of Ukraine must have the corresponding confirming documents (certificates);

f) in case of installation of the identification sign "Driver with disability" on the vehicle — a document confirming the disability of the driver or passenger (except for drivers with obvious signs of disability or drivers transporting passengers with obvious signs of disability).


2.2.

The owner of a vehicle, as well as a person using such vehicle on legal grounds, may transfer the control of the vehicle to another person who has a driving licence for the right to drive a vehicle of the corresponding category.

The owner of a vehicle may transfer such vehicle for use by another person who has a driving licence for the right to drive a vehicle of the corresponding category, by handing over the registration document for this vehicle.


2.3.

To ensure road safety, the driver is obliged to:

a) before departure, check and ensure the technically sound condition and completeness of the vehicle, correct placement and fastening of cargo;

b) be attentive, monitor the traffic situation, respond accordingly to its changes, monitor the correct placement and fastening of cargo, the technical condition of the vehicle and not be distracted from driving while on the road;

c) in vehicles equipped with passive safety devices (headrests, seat belts), use them and not carry passengers who are not wearing seat belts. In populated areas, drivers and passengers with disabilities whose physiological characteristics make it impossible to use seat belts, as well as drivers and passengers of emergency and special vehicles, are permitted not to wear seat belts;

d) when riding a motorcycle or moped, wear a fastened motorcycle helmet and not carry passengers without fastened motorcycle helmets;

e) not pollute the roadway and the right-of-way of motor roads;

f) not create a threat to road safety by one's actions;

g) report to road maintenance organizations or authorized units of the National Police about identified facts of obstruction to road traffic;

h) not commit actions that may damage motor roads and their components, as well as cause harm to users.


2.4.

At the request of a police officer, the driver must stop in compliance with the requirements of these Rules, and also:

a) present for inspection the documents specified in paragraph 2.1;

b) allow inspection of the unit numbers and completeness of the vehicle;

c) allow inspection of the vehicle in accordance with the legislation if there are legal grounds for this, including conducting a technical condition check of vehicles using special devices (instruments) that are subject to mandatory technical inspection in accordance with the legislation.


2.4.1.

At the location of dimensional-weight control, at the request of the dimensional-weight control point worker or police officer, the driver of a truck (including a motor vehicle) must stop in compliance with the requirements of these Rules, and also:

a) submit for inspection the documents specified in subparagraphs "a", "b" and "d" of paragraph 2.1 of these Rules;

b) provide the vehicle and trailer (if any) for weight and/or dimensional control in accordance with the established procedure.


2.4.2.

If during dimensional-weight control a discrepancy between actual weight and/or dimensional parameters and established norms and rules is found, the movement of such vehicle and/or trailer is prohibited until obtaining, in the established procedure, a permit for passage on motor roads of vehicles whose weight or dimensional parameters exceed the normative ones, for which a corresponding act is drawn up.


2.4.3.

On road sections within the border strip and controlled border area, at the request of an authorized person of the State Border Guard Service, the driver must stop in compliance with the requirements of these Rules, and also:

a) present for inspection the documents specified in subparagraph "b" of paragraph 2.1;

b) allow inspection of the vehicle and verification of its unit numbers.


2.5.

The driver must, at the request of a police officer, undergo a medical examination in the established procedure to determine the state of alcohol, drug or other intoxication or being under the influence of medications that reduce attention and reaction speed.


2.6.

By decision of a police officer, if there are appropriate grounds, the driver is obliged to undergo an extraordinary medical examination to determine the ability to safely operate a vehicle.


2.7.

The driver, except for drivers of vehicles of diplomatic and other missions of foreign states, international organizations, emergency and special vehicles, must provide the vehicle to:

a) police officers and healthcare workers for delivery to the nearest healthcare facility of persons who need emergency (ambulance) medical assistance;

b) police officers for performing unforeseen and urgent official duties related to pursuing offenders, delivering them to National Police bodies, and for transporting damaged vehicles.

Note No. 1. Only trucks are used for transporting damaged vehicles.

Note No. 2. The person who used the vehicle must issue a certificate indicating the distance travelled, duration of the trip, their surname, position, certificate number, and full name of their unit or organization.


2.8.

A driver with a disability who drives a motorized wheelchair or a car marked with the identification sign "Driver with disability", or a driver transporting a passenger with a disability, may deviate from the requirements of road signs 3.1, 3.2 and 3.35 — 3.38, as well as sign 3.34 if there is plate 7.18 underneath it.


2.9.

The driver is prohibited from:

a) driving a vehicle in a state of alcohol, drug or other intoxication or being under the influence of medications that reduce attention and reaction speed;

b) driving a vehicle in a sickly state, in a state of fatigue, as well as being under the influence of medications that reduce reaction speed and attention;

c) driving a vehicle not registered with the authorized body of the MIA, or one that has not undergone departmental registration if the law establishes the obligation to do so, as well as without a license plate or with a license plate that:

  • does not belong to this vehicle;
  • does not meet standard requirements;
  • is not mounted in the designated place;
  • is covered by other objects or dirty, making it impossible to clearly identify the license plate symbols from a distance of 20 m;
  • is not illuminated (during the dark hours or in conditions of insufficient visibility) or turned upside down;

d) transfer control of a vehicle to persons who are in a state of alcohol, drug or other intoxication or under the influence of medications that reduce attention and reaction speed, or in a sickly state;

e) transfer control of a vehicle to persons who do not have a licence to drive it, unless this relates to driving instruction in accordance with the requirements of Section 24 of these Rules;

f) while the vehicle is moving, use communication devices while holding them in the hand (except for drivers of emergency vehicles during the performance of an urgent official assignment);

g) use the identification sign "Driver with disability" in the absence of documents confirming the disability of the driver or passenger (except for drivers with obvious signs of disability or drivers transporting passengers with obvious signs of disability).


2.10.

In case of involvement in a road traffic accident, the driver is obliged to:

a) immediately stop the vehicle and remain at the scene of the accident;

b) activate the hazard warning lights and place a warning triangle in accordance with the requirements of paragraph 9.10 of these Rules;

c) not move the vehicle and objects related to the accident;

d) take possible measures to provide pre-medical assistance to the injured, call an emergency (ambulance) medical brigade, and in case of impossibility to take the said measures, seek help from those present and send the injured to a healthcare facility;

e) if it is impossible to perform the actions listed in subparagraph "d" of paragraph 2.10 of these Rules, transport the injured person to the nearest medical facility by one's own vehicle, having previously recorded the location of the accident traces and the position of the vehicle after its stop; at the medical facility, report one's surname and the vehicle license plate number (presenting the driving licence or other identity document, the vehicle registration document) and return to the scene of the accident;

f) report the road traffic accident to the body or authorized unit of the National Police, record the surnames and addresses of witnesses, and wait for the arrival of police officers;

g) take all possible measures to preserve the traces of the accident, fence them off, and organize a detour around the scene;

h) until the medical examination is conducted, not consume without the prescription of a medical worker alcohol, drugs, as well as medications made on their basis (except those included in the officially approved first-aid kit composition).


2.11.

If as a result of a road traffic accident there are no injured persons and no material damage has been caused to third parties, and the vehicles can move safely, the drivers (if there is mutual agreement in assessing the circumstances of the incident) may proceed to the nearest post or to the body of the National Police to process the corresponding materials, having previously drawn up a diagram of the accident and signed it.

Third parties are other road users who, due to circumstances, found themselves involved in the road traffic accident.

In the event of a road traffic accident involving vehicles specified in a valid compulsory civil liability insurance contract, provided that such vehicles are operated by persons whose liability is insured, there are no injured (deceased) persons, and provided that the drivers of such vehicles reach agreement regarding the circumstances of the road traffic accident, in the absence of signs of alcohol, drug or other intoxication or being under the influence of medications that reduce attention and reaction speed, and in the case of such drivers compiling a joint notification of the road traffic accident in accordance with the form established by the Motor (Transport) Insurance Bureau. In such case, the drivers of the mentioned vehicles, after compiling the notification referred to in this paragraph, are released from the obligations provided for in subparagraphs "f" — "h" of paragraph 2.10 of these Rules.


2.12.

The vehicle owner has the right to:

a) entrust, in the established procedure, the management of the vehicle to another person;

b) reimbursement of expenses in case of providing the vehicle to police officers and healthcare workers in accordance with paragraph 2.7 of these Rules;

c) compensation for damages caused as a result of the non-compliance of motor roads, streets, and railway crossings with road safety requirements;

d) safe and comfortable conditions for movement;

e) request operational information about road conditions and directions of movement.


2.13.

The right to drive vehicles may be granted to persons:

  • motor vehicles and motorized wheelchairs (categories A1, A) — from the age of 16;
  • cars, wheeled tractors, self-propelled machines, agricultural machinery, other mechanisms operating on the road network, of all types (categories B1, B, C1, C), except buses, trams and trolleybuses — from the age of 18;
  • cars with trailers or semi-trailers (categories BE, C1E, CE), as well as those intended for the transport of oversized, overweight and dangerous goods — from the age of 19;
  • buses, trams and trolleybuses (categories D1, D, D1E, DE, T) — from the age of 21.

Vehicles belong to the following categories:

  • A1 — mopeds, motor scooters and other two-wheeled vehicles with an engine displacement of up to 50 cc or an electric motor with a power of up to 4 kW;
  • A — motorcycles, including those with a sidecar, and other two-wheeled vehicles with an engine displacement of 50 cc or more or an electric motor with a power of 4 kW or more;
  • B1 — quadricycles and tricycles, motorized wheelchairs and other three-wheeled (four-wheeled) motor vehicles with a maximum authorized mass not exceeding 400 kilograms;
  • B — automobiles with a maximum authorized mass not exceeding 3,500 kilograms (7,700 pounds) and the number of seats, excluding the driver's seat, not exceeding eight; vehicle combinations with a category B towing vehicle and a trailer with a total mass not exceeding 750 kilograms;
  • C1 — automobiles intended for the transport of goods with a maximum authorized mass from 3,500 to 7,500 kilograms (from 7,700 to 16,500 pounds); vehicle combinations with a category C1 towing vehicle and a trailer with a total mass not exceeding 750 kilograms;
  • C — automobiles intended for the transport of goods with a maximum authorized mass exceeding 7,500 kilograms (16,500 pounds); vehicle combinations with a category C towing vehicle and a trailer with a total mass not exceeding 750 kilograms;
  • D1 — buses intended for the transport of passengers with the number of seats, excluding the driver's seat, not exceeding 16; vehicle combinations with a category D1 towing vehicle and a trailer with a total mass not exceeding 750 kilograms;
  • D — buses intended for the transport of passengers with the number of seats, excluding the driver's seat, exceeding 16; vehicle combinations with a category D towing vehicle and a trailer with a total mass not exceeding 750 kilograms;
  • BE, C1E, CE, D1E, DE — vehicle combinations with a category B, C1, C, D1 or D towing vehicle and a trailer with a total mass exceeding 750 kilograms;
  • T — trams and trolleybuses.

2.14.

The driver has the right to:

a) drive a vehicle and carry passengers or cargo on roads, streets or other places where their movement is not prohibited, in the established order in accordance with the requirements of these Rules;

b) excluded based on Cabinet of Ministers Resolution No. 1029 of 26.09.2011;

c) know the reason for stopping, checking and inspecting the vehicle by an official of a state body exercising supervision over road traffic, as well as their surname and position;

d) require the person exercising supervision over road traffic who stopped the vehicle to present their identity document;

e) receive necessary assistance from officials and organizations participating in ensuring road safety;

f) appeal the actions of a police officer in case of violation of legislation by them;

g) deviate from the requirements of legislation in conditions of force majeure or when it is impossible by other means to prevent one's own death or injury to citizens.


2.15.

A taxi driver has the right to:

a) drive on a road with a lane for route transport vehicles marked with road sign 5.8 or 5.11;

b) pick up and drop off passengers within the lane for route transport vehicles marked with road sign 5.8 or 5.11, taking into account the provisions of paragraphs 15.1 and 15.2 of these Rules.
