46.1. In which cases is a driver allowed to deviate from the requirements of the legislation?

The driver has the right to: … e) deviate from the requirements of the legislation in conditions of force majeure or when it is impossible by other means to prevent their own death or injury to citizens.
This subclause directly establishes two permissible cases when a driver may deviate from the requirements of the legislation: 1) in the presence of force majeure; and/or 2) when it is otherwise impossible to prevent death or injury (their own or of citizens).
That is, the correct answer is "In the cases specified in points 1 and/or 2," given that according to the definition in the Traffic Rules, clause 2.14 "e" allows deviation from the requirements of the legislation precisely in the presence of force majeure and/or when it is impossible by other means to prevent death or injury.
Under normal circumstances, the driver is obliged to strictly comply with the requirements of the Traffic Rules and other legal regulations. Therefore, the wording in the question “has the right to deviate” immediately suggests that this refers to an exception that is directly provided for by the Traffic Rules themselves.
Such an exception is contained in clause 2.14 of the Traffic Rules of Ukraine, where among the rights of the driver, the possibility to deviate from the requirements of the law is provided for in two situations. The first situation is when force majeure is in effect, that is, an extraordinary circumstance that cannot be foreseen or controlled (for example, a sudden collapse, natural disaster, or another event that objectively forces one to act outside the standard rules).
The second situation is when it is impossible by other means to prevent one's own death or the injury of citizens. That is, this is a case of extreme necessity: the driver chooses the least dangerous course of action to avert much more serious consequences. For example, if due to a sudden technical failure or another critical event there is a real threat of a fatal collision, and the only way to avoid it is to perform a maneuver that formally means deviating from a particular requirement, the Traffic Rules allow such an action precisely to preserve life and health.
It is important that these two grounds in the Traffic Rules are formulated as alternatives: deviation is permitted either due to force majeure or due to the impossibility of otherwise preventing death or injury. That is why the correct answer in the test should cover both cases, not just one of them.
Thus, the correct answer is "In the cases specified in items 1 and/or 2," since clause 2.14 of the Traffic Rules allows the driver to deviate from the requirements of the law either in the presence of force majeure or in a state of extreme necessity, when it is otherwise impossible to prevent death or injury to people.
