Clause 1.10 (the term "Road Traffic Accident")

Road traffic accident — an event that occurred during the movement of a vehicle, as a result of which people were killed or injured, or material damage was caused.

Clause 2.10 (driver's duties in case of involvement in a road traffic accident)

In case of involvement in a road traffic accident, the driver is obliged to:

a) immediately stop the vehicle and remain at the scene of the accident;

b) turn on the hazard warning lights and set up the emergency stop sign in accordance with the requirements of clause 9.10 of these Rules;

c) not move the vehicle and objects related to the accident;

d) take possible measures to provide first aid to the injured, call (notify) emergency medical services, and if necessary — send the injured to the nearest medical facility, having first recorded in the presence of witnesses the location of accident traces, as well as the position of the vehicle after it has stopped;

e) report the road traffic accident to the relevant authority or unit of the National Police, record the names and addresses of witnesses, and wait for the arrival of police officers;

f) take all possible measures to preserve the traces of the accident, cordon them off, and organize a detour of the accident site;

g) if necessary, clear the carriageway, having first recorded in the presence of witnesses the location of accident traces, as well as the position of the vehicle after it has stopped.

Brief explanation of application: the requirement of subparagraph "d" of clause 2.10 ("take possible measures…") also covers actions by the driver aimed at eliminating danger to people after an accident, in particular the organized removal/disembarkation (evacuation) of passengers from the damaged vehicle, if this is necessary for their safety and/or provision of assistance.

For example, if after the impact there is a smell of fuel or smoke, it is dangerous to leave passengers in the car even for a few minutes. Or if the car has stopped in a traffic lane or on a shoulder with limited visibility, the passengers inside remain at risk of another accident. In such situations, it is the driver who must quickly assess the situation and ensure the passengers exit the vehicle.

Therefore, the correct answer is "Must in any case," since the driver is obliged to ensure the safety of passengers after an accident and, knowing the emergency procedures, must organize their evacuation from the damaged vehicle to eliminate the risk of additional danger.
