Clause 12.6

Outside populated areas on all roads and on roads passing through populated areas marked with sign 5.51 "Beginning of a populated area", the following speed limits apply: a) buses (minibuses) transporting organized groups of children, passenger cars with trailers, and motorcycles — no more than 80 km/h; b) vehicles driven by drivers with less than 2 years of experience — no more than 70 km/h; c) trucks carrying people in the cargo bed and mopeds — no more than 60 km/h; d) buses (except minibuses) — no more than 90 km/h; e) other vehicles: on a motorway marked with road sign 5.1 "Motorway" — no more than 130 km/h, on a road with separate carriageways divided by a median strip — no more than 110 km/h, on other roads — no more than 90 km/h.

Application: subparagraph "c" sets a special (lower) speed limit for trucks carrying people in the cargo bed, and it applies outside populated areas on all roads, including motorways.

Clause 1.10 (term "Truck")

Truck — a vehicle that, by its design and equipment, is intended for the carriage of goods.

Clause 1.10 (term "Motorway")

Motorway — a road that: • is specially constructed and intended for vehicle traffic, not intended for entry to or exit from adjacent areas; • has separate carriageways for each direction of travel, divided by a median strip; • does not intersect at the same level with other roads, railways, tram lines, pedestrian and bicycle paths, animal crossings, has barriers on the roadsides and median strip, and is also fenced with mesh; • is marked with road sign 5.1 "Motorway".

Clause 33.5.1 — 33 "Road Signs", 5 "Informational and Direction Signs", sign 5.1 "Motorway"

Sign 5.1 "Motorway" is used to designate roads where the relevant traffic regimes are established in accordance with Section 27 of these Rules. The sign is installed at the beginning of the motorway.

Clause 33.5.51 — 33 "Road Signs", 5 "Informational and Direction Signs", sign 5.51 "Beginning of a Populated Area"

Sign 5.51 "Beginning of a Populated Area" marks the beginning of a populated area where the requirements of these Rules apply, determining the procedure for traffic within populated areas (including different speed limits).

Thus, the correct answer is "60 km/h", given that according to the definition of the Traffic Rules, for trucks carrying people in the cargo bed, outside populated areas on all roads (including motorways), clause 12.6(c) sets a maximum speed of no more than 60 km/h.

When it comes to the movement of a truck carrying people in the cargo bed, the general speed limit for highways does not apply; instead, a special rule for this type of transportation is used. That is, it is important to consider not only the type of road but also the category of the vehicle and the nature of the transportation.

Clause 12.6 of the Traffic Rules of Ukraine separately defines speed limits for different types of vehicles outside populated areas. Among them, it is directly stated that trucks carrying people in the cargo bed are allowed to travel at a speed of no more than 60 km/h. This is a special restriction established due to the increased risks for passengers when transported in the cargo bed.

A highway (marked with sign 5.1) does indeed provide for higher permitted speeds for most vehicles. However, these increased limits apply to "other vehicles," and not to those for which clause 12.6 sets separate, lower limits. Therefore, a truck with people in the cargo bed, even when traveling on a highway, is not allowed to follow the 130 km/h limit.

For example, if a truck is carrying people in the cargo bed and enters a road marked with sign 5.1 "Highway," the driver is still required to observe the special 60 km/h limit, as this is the rule set for such transportation.

Thus, the correct answer is "60 km/h," because for trucks carrying people in the cargo bed, clause 12.6 of the Traffic Rules establishes a special speed limit, which also applies on highways.
