This exam question from the Traffic Rules of Ukraine concerns one of the most serious topics in road safety: which driver actions may result in legal deprivation of the right to drive. The theoretical exam tests not only knowledge of traffic rules, but also understanding of the consequences of certain violations, since the revocation of a driver’s license is applied for the most dangerous actions or those that have already caused harm.

The question covers several sections of the Traffic Rules and typical situations: duties and prohibitions for drivers of motor vehicles (section 2, in particular the requirement to undergo an examination and the prohibition of driving under the influence), rules for crossing railway crossings (section 20), and general provisions for safe behavior on the road (section 1). The logic of the correct choice is as follows: for driving under the influence of alcohol, drugs, or other intoxicants (as well as for refusing an examination or allowing an intoxicated person to drive), the court may deprive you of the right to drive; similarly, deprivation is possible for entering a railway crossing when movement is prohibited (this is a critically dangerous violation); and for violating traffic rules that caused damage to vehicles or other property (a typical accident with material consequences). In contrast, driving an unregistered or not re-registered vehicle from the list provided usually results in a fine, but is not the basis in this exam question for deprivation of the right to drive.

The practical value of the topic is that the learner learns to distinguish between violations that result in a "fine" and those for which the right to drive may be temporarily revoked. For preparation for the theoretical exam, it is important to remember: intoxication and related actions, dangerous crossing of a railway crossing against a prohibition, as well as traffic violations with material damage, belong to the most strictly punished categories where revocation of the driver’s license is possible.

Clause 2.5 (Section 2 "Duties and Rights of Drivers of Motor Vehicles")

The driver must, at the request of a police officer, undergo a medical examination in the prescribed manner to determine the state of alcoholic, narcotic, or other intoxication or being under the influence of medicinal drugs that reduce his attention and reaction speed.

Brief application: checks knowledge of the obligation to undergo an examination; refusal to undergo the examination constitutes an offense for which deprivation of the right to drive may be applied (corresponds to "refusal to undergo examination" in Article 130 of the Code of Ukraine on Administrative Offenses).

Clause 2.9 (Section 2 "Duties and Rights of Drivers of Motor Vehicles")

The driver is prohibited from:

a) driving a vehicle while under the influence of alcohol, narcotics, or other intoxication, or under the influence of medicinal drugs that reduce his attention and reaction speed;

b) allowing persons who are in such a state of intoxication or under the influence of such medicinal drugs to drive the vehicle;

d) consuming alcoholic beverages, narcotic substances, psychotropic substances, their analogues, or medicinal drugs made on their basis after a road traffic accident involving him or after the vehicle was stopped at the request of a police officer, until the relevant examination is conducted or a decision is made to release from such examination.

Brief application: checks the prohibition of driving under the influence and related actions — this is the basis for liability for which deprivation of the right to drive may be applied (Article 130 of the Code of Ukraine on Administrative Offenses).

Clause 20.5 (Section 20 "Movement through Railway Crossings")

Movement through a railway crossing is prohibited if:

a) the barrier is closed or begins to close;

b) a prohibitive signal of the traffic light is on or a sound signal is given;

c) a train (locomotive, railcar) is approaching the crossing within visible distance;

d) a traffic jam has formed on the crossing, which will force the driver to stop on the crossing;

e) the crossing attendant gives a signal prohibiting movement.

Brief application: checks the prohibition of entering the crossing when movement through it is prohibited; for such a violation, deprivation of the right to drive may be applied (Article 123, Part 2 of the Code of Ukraine on Administrative Offenses).

Clause 1.5 (Section 1 "General Provisions")

The actions or inaction of road users and other persons must not create danger or obstacles to traffic, threaten the life or health of citizens, or cause material damage.

Brief application: checks the basic obligation not to create danger and not to cause material damage; a traffic rules violation that caused property damage (an accident with material consequences) may result in deprivation of the right to drive (Article 124 of the Code of Ukraine on Administrative Offenses).

Clause 2.3 (subclause "b", Section 2 "Duties and Rights of Drivers of Motor Vehicles")

To ensure road safety, the driver is obliged to:

b) be attentive, monitor the road situation, respond appropriately to its changes, monitor the correct placement and securing of cargo, the technical condition of the vehicle, and not be distracted from driving this vehicle while on the road.

Brief application: checks the general duty of attentiveness and safe behavior; its violation combined with consequences in the form of damage to the vehicle/property creates grounds for liability with possible deprivation of the right to drive (Article 124 of the Code of Ukraine on Administrative Offenses).

That is, the correct answer is "Answers 1, 2, 3.", given that according to the definition of the Traffic Rules, violations related to driving under the influence/refusal to undergo examination (clauses 2.5, 2.9), entering a railway crossing when movement is prohibited (clause 20.5), and violations of safety requirements that led to material damage (clauses 1.5, 2.3) are those for which the law provides for possible deprivation of the right to drive.

Deprivation of the right to drive is not applied for any violation, but only for those actions of the driver that the law directly classifies as serious and dangerous. In the exam, this question tests the ability to distinguish violations for which only a fine is provided from those for which the court may additionally impose deprivation of the right to drive.

The first situation (answer 1) concerns driving under the influence of alcohol, drugs, or other intoxication, as well as refusal to undergo an intoxication test or allowing an intoxicated person to drive. Such actions create increased danger for all road users, so the law provides for the possibility of deprivation of the right to drive for a specified period.

The second situation (answer 2) is entering a railway crossing when movement through it is prohibited. This is one of the most risky types of violations: even a brief "attempt to rush through" can lead to serious consequences. That is why for such a violation, in addition to a fine, deprivation of the right to drive may also be imposed.

The third situation (answer 3) is a violation of the Traffic Rules that caused damage to vehicles or other property (a typical example: the driver did not maintain a safe distance and collided, resulting in damage to the car). In such cases, the law also allows deprivation of the right to drive, since the consequences of the violation are already materially confirmed by the damage.

At the same time, violations such as problems with registration or license plates from the given list usually result in a fine, but not deprivation of the right to drive, so they are not included in the correct answer option for this question.

Therefore, the correct answer is "Answers 1, 2, 3," since for driving under the influence (or refusal to be tested), for entering a railway crossing when movement is prohibited, and for a traffic accident with property damage, the law provides for the possibility of deprivation of the right to drive.
