This exam question from the Traffic Rules of Ukraine concerns road safety and the mandatory equipment of vehicles. The theoretical exam often includes topics related to what a driver must have with them and in working order, since the absence of basic first aid supplies, fire extinguishing equipment, or emergency signaling devices can directly affect the consequences of an accident and the safety of passengers and other road users.
The question tests knowledge of the section of the Traffic Rules regarding technical condition and prohibition of operation, specifically item 31.4.7 of the Traffic Rules of Ukraine (other structural elements). This item directly lists the categories of vehicles for which the absence of a first aid kit means operation is prohibited: motorcycle with a sidecar, passenger cars and trucks, buses, minibuses, trolleybuses, wheeled tractors, as well as vehicles transporting dangerous goods. At the same time, two-wheeled motorcycles without a sidecar are not mentioned in the list, so they may be operated without a first aid kit without violating the requirements of this item.
The analysis of options in such tasks comes down to carefully reading the list in 31.4.7: cars and buses are specified there, so for them a first aid kit is mandatory, and driving without one is not allowed. The statement about all motorcycles is also incorrect, because a motorcycle with a sidecar is directly included in the list of vehicles that must be equipped with a first aid kit. In practice, this means a simple rule for preparing for the theoretical exam: if the type of vehicle is named in item 31.4.7, a first aid kit is mandatory; if not named (as in the case of a motorcycle without a sidecar), this requirement does not apply according to this rule.
Clause 31.4
“Operation of vehicles is prohibited, according to legislation, if the following technical malfunctions are present or the following requirements are not met:”
Clause 31.4.7 (Other structural elements)
“a first aid kit marked with information about the type of vehicle for which it is intended — on a motorcycle with a sidecar, a passenger car, a truck, a wheeled tractor, a bus, a minibus, a trolleybus, a vehicle transporting dangerous goods;
a warning triangle (flashing red lamp) that meets the standard requirements — on a motorcycle with a sidecar, a passenger car, a truck, a wheeled tractor, a bus;
on trucks with a permitted maximum mass of more than 3.5 t and on buses with a permitted maximum mass of more than 5 t — wheel chocks (at least two);
orange flashing beacons on heavy and oversized vehicles, on agricultural machinery with a width exceeding 2.6 m;
a working fire extinguisher on a passenger car, truck, bus.
1. The type, brand, and installation locations of additional fire extinguishers with which vehicles transporting radioactive and certain dangerous goods are equipped are determined by the conditions for the safe transportation of the specific dangerous goods.
2. A first aid kit, the list of medicines of which complies with DSTU 3961-2000 for the corresponding type of vehicle, and a fire extinguisher must be secured in places determined by the manufacturer. If such places are not provided by the vehicle’s design, the first aid kit and fire extinguisher must be placed in easily accessible locations. The type and quantity of fire extinguishers must comply with established standards. Fire extinguishers provided for vehicles must be certified in Ukraine in accordance with legal requirements.”
The provisions of clause 31.4.7 establish the mandatory presence of a first aid kit only for the directly listed categories of vehicles (in particular, for a “motorcycle with a sidecar”), while a “motorcycle without a sidecar” is not included in this list.
Thus, the correct answer is “Only motorcycles without a sidecar,” given that, according to the Traffic Rules, the requirement for the mandatory presence of a first aid kit (and the prohibition of operation in its absence) is established by clause 31.4.7 only for the vehicles specified therein, and motorcycles without a sidecar are not among them.
To answer this question, you need to refer to clause 31.4.7 of the Traffic Rules of Ukraine, which defines the cases when the operation of a vehicle is prohibited due to the absence of mandatory equipment items, in particular, a first aid kit.
This clause directly lists the vehicles that must be equipped with a first aid kit. Among them are, in particular, a motorcycle with a sidecar, a passenger car, a truck, a bus, a minibus, a trolleybus, a wheeled tractor, and a vehicle transporting dangerous goods. That is, for these categories, the absence of a first aid kit means a prohibition on operation.
At the same time, motorcycles without a sidecar are not mentioned in this list. This is a crucial point: if the Rules establish the obligation to have a first aid kit only for specifically named vehicles, then for those not specified, this requirement does not apply. That is why a two-wheeled motorcycle without a sidecar can be operated without a first aid kit, without violating clause 31.4.7.
For example: if a driver operates a passenger car without a first aid kit, this is grounds to consider the operation prohibited according to the Traffic Rules. But if a driver operates a motorcycle without a sidecar, the absence of a first aid kit does not fall under the prohibition, because this category is not included in the list in clause 31.4.7.
Therefore, the correct answer is "Only motorcycles without a sidecar," since clause 31.4.7 of the Traffic Rules requires a first aid kit only for clearly listed vehicles, and a motorcycle without a sidecar is not included in this list.
