40.8. Is a moped driver allowed to enter the area of effect of the depicted road sign?
UAЧи дозволено водієві мопеда рух у зону дії зображеного дорожнього знака?
This exam question from the Traffic Rules of Ukraine tests attentiveness to prohibitory road signs and the ability to correctly assess movement restrictions for different categories of vehicles. Such topics are directly related to road safety, as incorrect interpretation of signs leads to violations, conflicts in traffic flow, and increases the risk of accidents.
In terms of content, it belongs to section 33 of the Traffic Rules, group 3 "Prohibitory signs," specifically to sign 3.7 "Mopeds prohibited." The theoretical exam often includes situations where it is necessary not only to recognize the sign but also to know its area of effect: the restriction starts from the place where the sign is installed and continues to the nearest intersection, and in the absence of intersections within a populated area—to its end. It is important to remember that exits from adjacent territories or junctions with dirt roads without priority signs do not cancel the effect of this restriction.
The analysis of the answer options comes down to the essence of the sign: the option "Prohibited" is correct because sign 3.7 directly prohibits the movement of mopeds (as well as bicycles with an auxiliary engine) in its area of effect. The option "Allowed" is possible only in exceptions provided by the traffic rules: when the vehicle serves businesses in this area or belongs to/is used by citizens who live or work here, and then entry and exit must be made through the intersection closest to the destination. In a standard situation without such grounds, moped movement into this area is considered a violation of the Traffic Rules of Ukraine.
Clause 1.10 (term "Moped")
Moped — a two-wheeled vehicle equipped with an engine with a working volume up to 50 cc or an electric motor with a power up to 4 kW and a maximum design speed not exceeding 50 km/h.
Clause 33.3 — 33 "Road signs", 3 "Prohibitory signs", sign 3.7 "Mopeds prohibited"
Sign 3.7 "Mopeds prohibited" prohibits the movement of mopeds and bicycles with an auxiliary engine. The sign does not apply to vehicles serving citizens or belonging to citizens who live or work in this area, as well as to vehicles serving enterprises located in the designated area. In such cases, vehicles must enter and exit the designated area at the intersection closest to their destination. The area of effect of the sign extends from the place of installation to the nearest intersection beyond it, and in populated areas where there are no intersections — to the end of the populated area. The effect of the sign is not interrupted at places where roads adjoin from adjacent territories or at intersections (junctions) with field, forest, and other unpaved roads, before which no priority signs are installed.
Thus, the correct answer is "Prohibited.", given that according to the definition of the Traffic Rules, sign 3.7 directly prohibits the movement of mopeds in the area of its effect (in the absence of the exceptions specified in the Traffic Rules).
When approaching the depicted sign, the driver must understand that this is prohibitory sign 3.7, which imposes a restriction specifically for mopeds (as well as bicycles with an auxiliary engine). That is, after the location of the sign, riding a moped in this area is considered a violation unless there are special grounds for entry.
The area of effect of such a sign begins directly from the place where it is installed and continues to the nearest intersection beyond the sign. If it is a populated area with no intersections, the restriction remains in effect until the end of the populated area. It is important to note that exits from adjacent territories or junctions with dirt roads without priority signs do not terminate the effect of this restriction.
Exceptions are possible only in cases defined by the Traffic Rules: when the moped belongs to a person who lives or works in this area, or when the vehicle is servicing an enterprise located within the area of the sign. Even then, entry and exit must be made through the intersection closest to the destination. If there are no such grounds, entering the area of the sign is not allowed for the moped driver.
Therefore, the correct answer is "Prohibited," since sign 3.7 directly prohibits moped movement within its area of effect.
