In case of involvement in a road traffic accident, the driver is obliged to:
a) immediately stop the vehicle and remain at the scene of the accident;
b) turn on the hazard warning lights and set up the emergency stop sign in accordance with these Rules;
c) not move the vehicle and objects related to the accident;
d) take possible measures to provide pre-medical aid to the victims, call (if necessary) emergency medical assistance;
e) report the road traffic accident to the National Police, record the names and addresses of witnesses, and wait for the arrival of the police officers;
f) if necessary, transport the victims to the nearest healthcare facility, after first recording the location of accident traces and the position of the vehicle after it has stopped; at the healthcare facility, provide your surname and the registration number of the vehicle (presenting the relevant documents) and return to the scene of the accident;
g) clear the carriageway if the movement of other vehicles is impossible, after first recording in the presence of witnesses the position of the vehicle, accident traces, and the location of objects related to the accident.
Brief application: it is the requirement to “remain at the scene of the accident” that determines that unauthorized leaving of the accident scene is a violation of established rules.
Clause 2.11
If as a result of a road traffic accident there are no casualties and the vehicles can move, the drivers (by mutual agreement regarding the circumstances of the accident) may, after drawing up a diagram of the road traffic accident and signing it, clear the carriageway and arrive for documentation at the nearest unit of the National Police.
Brief application: this is the procedure provided by the Traffic Rules for “clearing the carriageway” and subsequent documentation, but it is not considered “fleeing” — the drivers act according to the procedure established by the Rules.
Article 122-4 of the Code of Ukraine on Administrative Offenses (CUAO)
Leaving the scene of a road traffic accident by drivers of vehicles or other road users in violation of established rules entails the imposition of a fine in the amount of fifteen non-taxable minimum incomes of citizens, or community service for a period of thirty to forty hours, or administrative arrest for a period of ten to fifteen days.
