33.3.63. Are you allowed in this situation to overtake a lorry with a trailer that is moving at a speed of less than 30 km/h?
UAЧи дозволено Вам у даній ситуації виконати обгін вантажного автомобіля з причепом, що рухається зі швидкістю менш ніж 30 км/год.?
This exam question from the Traffic Rules of Ukraine tests attentiveness to prohibitory signs and road markings during the overtaking maneuver, as well as the ability to apply exceptions to the rules without compromising road safety. Such situations often appear in the theoretical exam because a driver must not only "see" the prohibition but also correctly understand when it does not apply due to directly specified norms of the Traffic Rules.
The question relates to Section 33 "Road Signs," specifically sign 3.25 "Overtaking Prohibited," as well as Section 34 "Road Markings" (marking 1.1). Sign 3.25 generally prohibits overtaking but allows an exception for single vehicles moving at speeds less than 30 km/h; the Traffic Rules consider a road train (a truck with a trailer) as such a "single" vehicle. A similar exception is provided by the solid line 1.1: it is usually not allowed to cross it, but it is permitted to cross for overtaking a single vehicle moving at less than 30 km/h, provided it is safe.
Therefore, the option where the maneuver is allowed is correct: both the sign and the marking provide for exactly such an exceptional situation. On the other hand, the answer about prohibition would be correct in the general case of sign 3.25 and line 1.1, but here it does not take into account the exception for a road train/single vehicle moving slower than 30 km/h, which is explicitly stated in the traffic rules.
Clause 33.3 — 33 “Road Signs”, 3 “Prohibitory Signs”, sign 3.25 “Overtaking Prohibited”
“Sign 3.25 ‘Overtaking Prohibited’ forbids overtaking of all vehicles, except single vehicles moving at a speed of less than 30 km/h (single vehicles are considered to be individual vehicles, road trains, as well as a vehicle towing another vehicle in combination with the towed one).”
Clause 34.1 — 34 “Road Markings”, 1 “Horizontal Markings”, marking 1.1
“Marking 1.1 (narrow solid line) separates traffic flows in opposite directions and marks the boundaries of traffic lanes on roads; marks the boundaries of the carriageway where entry is prohibited; marks the boundaries of parking spaces, parking lots, and the edge of the carriageway on roads that are not classified as motorways. Crossing this line is prohibited. If this line marks a parking space or the edge of the carriageway adjacent to the shoulder, crossing the line is allowed. As an exception, provided road safety is ensured, it is permitted to cross this line to bypass a stationary obstacle whose dimensions do not allow safe bypassing without crossing the line, as well as to overtake single vehicles moving at a speed of less than 30 km/h.”
Clause 1.10 (term “Road Train”)
“Road train — a motor vehicle coupled with one or more trailers.”
Brief application: a truck with a trailer is a road train, and in the description of sign 3.25 it is explicitly stated that road trains are considered ‘single’ in the sense of the exception for overtaking at speeds below 30 km/h.
Clause 1.10 (term “Overtaking”)
“Overtaking — passing one or more vehicles involving entry into the oncoming traffic lane.”
Brief application: the question checks whether ‘overtaking’ (with entry into the oncoming lane) is allowed, despite sign 3.25 and solid line 1.1 — and whether the exception provided by the Traffic Rules for ‘single’ vehicles moving at less than 30 km/h applies.
That is, the correct answer is “Allowed.”, given that according to the definition in the Traffic Rules, sign 3.25 and marking 1.1 contain an exception: they allow overtaking of single vehicles (including road trains) moving at less than 30 km/h.
In this situation, first of all, we assess what restrictions are imposed by the road sign. Ahead of us is the prohibitory sign 3.25 “Overtaking prohibited.” The general rule for this sign is: it prohibits overtaking, but there is a clearly defined exception.
The exception concerns single vehicles moving at a speed of less than 30 km/h. It is important to understand that “single” in the context of the Traffic Rules means not only a passenger car without a trailer. Such single vehicles also include a road train, that is, a truck with a trailer, if it moves as a single unit in the flow of traffic.
The question explicitly states that the truck with a trailer is moving at a speed of less than 30 km/h. Therefore, it falls under the exception provided by sign 3.25, and in this specific situation, the sign does not prohibit overtaking this particular vehicle.
Additionally, attention should be paid to the solid line marking 1.1. Usually, crossing it is prohibited, but the rules also provide an exception: it is allowed to cross 1.1 to overtake a single vehicle moving at a speed of less than 30 km/h, provided it is safe to do so. That is, both the sign and the marking in this case have the same logic for the exception.
Therefore, the correct answer is “Allowed,” since the truck with a trailer is considered a single vehicle according to the Traffic Rules and is moving at less than 30 km/h, and both sign 3.25 and marking 1.1 permit overtaking in such an exceptional case, provided it is safe.
