UAЗа наявності якої несправності дозволяється експлуатація транспортного засобу?
Question without image
This exam question from the Traffic Rules of Ukraine tests knowledge of the requirements for the technical condition of a vehicle and which malfunctions make further operation dangerous and prohibited. The topic is directly related to road safety: even "minor" defects can lead to fuel leaks, reduced visibility, or loss of control over the driver's seating position, and therefore affect the risk of an accident.
The question belongs to Section 31 of the Traffic Rules, which defines technical malfunctions and the conditions under which operation is prohibited. The focus is on item 31.4 and sub-item 31.4.7 (d) ("Other structural elements"): it directly lists the breakdowns with which you are not allowed to drive on the road. That is why, in the theoretical exam, it is important not to "guess," but to refer to the wording of the list of prohibited malfunctions.
The analysis of the answer options is straightforward: faulty fuel tank cap locks are included in p. 31.4.7 (d), as they create a risk of fuel leakage; a non-functioning driver's seat adjustment mechanism is also directly mentioned, since the seat may shift during braking or acceleration; a faulty device for heating and blowing the glass prohibits operation due to the risk of fogging and loss of visibility. In contrast, the window regulator is not listed in this section, so the traffic rules do not prohibit operation solely due to its malfunction.
The practical benefit of this knowledge for the driver is obvious: before setting off, you can quickly distinguish malfunctions that require immediate repair (because driving is prohibited) from those that do not critically affect safety and are not grounds for prohibition under the Traffic Rules of Ukraine. This helps you answer exam questions correctly and at the same time keep your vehicle in a condition that is safe for you and other road users.
Clause 31.4
The operation of vehicles is prohibited according to the legislation in the presence of the following technical malfunctions and non-compliance with such requirements.
Clause 31.4.7 (section "Other structural elements"), subclause g)
The following do not work as provided by the design: body or cab door locks, sideboard locks of the cargo platform, neck locks of tanks and fuel tanks, driver's seat adjustment mechanism, emergency exits, devices for their activation, door control drive, speedometer, odometer, tachograph, device for heating and blowing the glass.
Explanation of application: the list given in clause 31.4.7 (d) consists of malfunctions for which operation is prohibited; malfunction of the window regulator is not specified in this list, therefore the Traffic Rules do not establish a prohibition on operation solely due to a non-working window regulator.
Thus, the correct answer is "The window regulator does not work," given that, according to the definition of the Traffic Rules, the prohibition of operation is established for malfunctions explicitly listed in clause 31.4.7 (d), and the window regulator is not included in this list.
In this question, you need to find such a malfunction with which the Traffic Rules do not prohibit the further operation of the vehicle. For this, refer to section 31 of the Traffic Rules, which lists technical malfunctions that prohibit driving.
Clause 31.4.7 (d) directly refers to the following as malfunctions of structural elements prohibited for operation, which affect safety and controllability: faulty door locks and latches (including fuel filler caps), a faulty driver's seat adjustment mechanism, as well as a faulty device for heating and blowing the glass. The logic is simple: if, for example, the fuel filler cap lock does not work, fuel leakage is possible; if the driver's seat is not fixed, it may shift during braking or acceleration; if the glass heating/blowing system does not work, in cold weather the risk of fogging and reduced visibility increases. Such malfunctions create danger, so operation with them is prohibited.
On the other hand, a malfunction of the window regulator (when the side window does not go up or down) is not listed among the prohibited malfunctions. Unlike locks, seat adjustment, or the glass blowing system, it does not pose a direct threat to driving, braking, or visibility in a typical situation and is not grounds for prohibiting operation under clause 31.4.7 (d).
Therefore, the correct answer is "The window regulator does not work," since this malfunction is not included in the list of technical malfunctions in clause 31.4.7 (d) for which the Traffic Rules prohibit the operation of the vehicle.
