Question without image

This is an exam question from the Traffic Rules of Ukraine concerning traffic safety when vehicles are moving in a convoy and the interaction of other drivers with such a convoy. In real-life situations, improper “merging” between vehicles in a convoy increases the risk of accidents, provokes sudden braking, and disrupts the organized order of movement, which is why the traffic rules clearly define when this is permissible.

The question tests knowledge of Section 25 of the Traffic Rules of Ukraine, “Movement of Vehicles in Convoys,” and primarily points 25.6 and 25.4. According to point 25.6, other vehicles are prohibited from occupying a place for permanent movement in the convoy, that is, it is not allowed to merge into it and drive “as a member of the convoy.” At the same time, point 25.4 provides that a convoy without the escort of emergency vehicles must be divided into groups with intervals sufficient for overtaking, and according to the definition of the term “overtaking” (point 1.10), during the maneuver it is possible to temporarily return to your lane between groups, which appears as a short-term merging.

The analysis of the answer options in this ticket for the theoretical exam is as follows: the option about further movement as part of the convoy contradicts the direct prohibition of point 25.6, so it is incorrect. The option about passing does not describe a situation where the driver needs to take a place in the convoy, since passing is performed in the adjacent lane of the same direction and does not require “merging.” Instead, the option related to overtaking is logically and normatively justified: when overtaking a group of a convoy on a road with one lane in each direction, the driver may temporarily find themselves between vehicles of the convoy in order to safely complete or interrupt the maneuver, and this is not considered prohibited “permanent movement” in the convoy.

Clause 25.6

Other vehicles are prohibited from occupying a place for continuous movement in a convoy.

This clause checks the understanding that “joining a convoy” (i.e., taking a place in it and continuing to move together with it) by outside vehicles is prohibited; the only actual exception is brief entry between convoy vehicles during the completion/interruption of an overtaking maneuver (not for “continuous movement” in the convoy).

Clause 25.4

A convoy moving without the escort of emergency vehicles must be divided into groups (no more than five vehicles in each), with a distance between them that ensures the possibility for other vehicles to overtake the group.

This clause directly establishes the possibility of overtaking the convoy (more precisely — its groups) by other vehicles if the convoy is moving without the escort of emergency vehicles.

Clause 1.10 (term “Overtaking”)

Overtaking — passing one or more vehicles involving entry into the oncoming traffic lane.

This term is important for understanding why, during overtaking of a convoy (or its group), a situation may arise where there is brief “insertion” between the vehicles of the convoy (for example, to complete overtaking safely), which does not constitute “occupying a place for continuous movement” as per clause 25.6.

Thus, the correct answer is: “When overtaking a convoy,” given that according to the definition in the Traffic Rules, overtaking allows for temporary presence between vehicles during the maneuver, while clause 25.6 specifically prohibits occupying a place for continuous movement in the convoy, and clause 25.4 provides for gaps between convoy groups to ensure the possibility of overtaking.

When a convoy of vehicles is moving on the road without the escort of emergency vehicles, there is a clear rule for other drivers: it is not allowed to “merge” into such a convoy and drive as a member of the convoy. This directly follows from the requirement of the Traffic Rules, which prohibit other vehicles from occupying a place for continuous movement within the convoy.

At the same time, the Traffic Rules stipulate that a convoy without escort must be organized in such a way that it can be overtaken: it should be divided into small groups, and the distance between the groups should allow other vehicles to overtake. That is, the very existence of such gaps shows that overtaking the convoy in this case is permitted.

In practice, during overtaking, a situation may arise when a driver, overtaking a group of the convoy on a road with one lane in each direction, is forced to temporarily return to their lane between the groups (for example, to give way to oncoming traffic) and for a short time finds themselves “inside” the convoy. Such temporary merging, necessary to complete the overtaking maneuver, is not considered “occupying a place for continuous movement,” but is an element of a permitted maneuver.

On the other hand, if a driver simply enters between the vehicles of the convoy and continues to drive with them without overtaking, this will be a prohibited occupation of a place in the convoy for continuous movement.

Therefore, the correct answer is "When overtaking a convoy," since the Traffic Rules prohibit continuous movement as part of a convoy, but allow temporary merging only as part of an overtaking maneuver.
