Question without image

This exam question from the Traffic Rules of Ukraine concerns the safe exit from an adjacent area and yielding the right of way when "merging" into the general traffic flow. Such situations occur daily near gas stations, parking lots, and courtyards, so proper understanding of the requirement to "give way (not create obstacles)" directly affects the safety of pedestrians and drivers, and is often checked in the theoretical exam.

The question tests the section of the Traffic Rules about starting to move and maneuvering, specifically the requirements of point 10.2: exiting a gas station is equated to exiting from an adjacent area, not to passing through an intersection. This means that the driver, before the sidewalk and before the roadway, is obliged to yield to those already moving on them: pedestrians on the sidewalk and all vehicles on the road, regardless of whether additional signs are installed at the exit.

The analysis of the answer options comes down to whom exactly the right of way is given. Option 1 is incorrect because it limits the obligation only to cars and cyclists and ignores pedestrians on the sidewalk. Option 2 is also incorrect: it limits the vehicles on the roadway only to cyclists and motorcyclists, although according to the traffic rules, the right of way is given to all vehicles moving on the road. The correct approach reflects the full requirement of point 10.2 and covers both pedestrians and all vehicles on the roadway or sidewalk.

Practically, this means: before exiting a gas station, you should turn on your turn signal in advance, reduce speed to a minimum, check the sidewalk, bicycle infrastructure (if crossing it), and the roadway, and only then perform the maneuver without forcing other road users to change speed or direction. This algorithm helps to answer exam questions without mistakes and to act safely in real road conditions.

Clause 10.2

When entering the road from a residential area, yards, parking lots, gas stations, and other adjacent territories, the driver must yield to pedestrians and vehicles moving along the roadway or sidewalk before entering them, and when leaving the road — to cyclists and pedestrians whose direction of movement he crosses.

Clause 1.10 (term “Driver”)

Driver — a person who operates a vehicle and has a driver’s license (tractor driver’s license, temporary permit to drive a vehicle, temporary voucher to drive a vehicle) of the appropriate category. A driver is also a person who teaches driving while being directly in the vehicle.

Clause 1.10 (term “Yield (do not create obstacles)”)

Yield (do not create obstacles) — a requirement for a road user not to continue or resume movement, nor to make any maneuvers, if this may force other road users who have the right of way to change their direction or speed.

Clause 1.10 (term “Adjacent territory”)

Adjacent territory — an area adjacent to the edge of the roadway and not intended for through traffic of vehicles (yards, residential areas, parking lots, gas stations, enterprises, etc.).

That is, the correct answer is: “Before the roadway or sidewalk, yield to pedestrians and vehicles moving along it,” considering that when leaving a gas station as an adjacent territory, the driver, according to clause 10.2, is required to yield to pedestrians and vehicles moving along the roadway or sidewalk.

After refueling, you are leaving the territory of the gas station onto the road. A gas station is considered an adjacent territory, and exiting from it is not regarded as an intersection. Therefore, the rules for passing intersections and the definitions of “main/secondary” as for intersections do not apply here; instead, a separate requirement of the Rules applies to exiting from adjacent territories.

According to point 10.2 of the Traffic Rules of Ukraine, a driver exiting from yards, parking lots, gas stations, and other adjacent territories must yield, before entering the carriageway or sidewalk, to those already moving on the road. The logic is simple: you are just now “joining” the traffic, and therefore, you cannot create an obstacle for those participants who are already moving along the carriageway or walking on the sidewalk.

In practice, this means that before leaving a gas station, you need to turn on your turn signal in advance, assess the situation, and yield to pedestrians on the sidewalk (even if there is no pedestrian crossing nearby), as well as to all vehicles moving on the carriageway. If you are crossing bicycle infrastructure at the exit, the same principle applies: you do not have the right to “cut in” ahead of those moving on the road or on the path you are crossing.

Therefore, the correct answer is: "Before the carriageway or sidewalk, yield to pedestrians and vehicles moving on it," because when exiting a gas station as from an adjacent territory according to point 10.2, you are required to yield to pedestrians and all vehicles already moving on the road or sidewalk.
